Bloom is an app for iOS and Android that allows you to post photos and videos to a location. This is a fun way to connect with your followers, family and friends!
These Terms of Service (hereby referred to as “Terms”) are drafted so you know the rules that apply to you when you use any Bloom products or services (hereby referred to as “Services”) that link to these Terms. These Terms form a legally binding contract between you, Bloom and Ready App One LLC, which is the owner of the Bloom app. Please read these Terms carefully.
In order to use our Services, you are required to accept these Terms that were presented to you when you first open the Bloom app or when we make any changes to the Terms. If you do not accept the Terms, you cannot use the Services.
No one under 13 is allowed to create an account or use the Services. We may also offer additional services that require you to be even older to use them.
By using the Services, you state that (i) you can form a binding contract with Bloom and Ready App One LLC, and (ii) you are not barred from receiving the Services under the laws of the United States or any other applicable jurisdiction, and (iii) you are not a convicted sex offender, and (iv) you will comply with these Terms as wel as all applicable local, state, national, international and interplanetary laws, rules and regulations.
The services should not be used for business and commercial purposes. If you want to use the services for business or commercial purposes please contact us at support@bloomappone.com and make a request.
You must create an account to use the Services. Creating an account is done inside the app. Here is some important information for you to know regarding your account:
In order to use the Services you need to pick a username. Your username will be displayed when you use the app. Currently, there is no way to change your username.
We reserve the right to review all usernames and change them at our discretion or delete your account if your username is found to be imitating another business, brand or person.
We reserve the right to give your username to another user who already has that username or identity established as a business, brand or personality. If this happens, we will change your username to a temporary username and allow you to pick a new username. If you were found to be imitating said entity, your account will be deleted.
An active phone number is required to create an account. We ask you to verify your phone number so we know it is yours. Your phone number is never revealed to other users on Bloom. If you have any issues with your account and phone number, contact us at support@bloomappone.com.
Bloom is a location based app. In order to fully use the services, your location is required. We also need to store your location data to be able to fully provide the Services to you. For more information on how we use your geolocation data please look at the Privacy Policy.
You can send an invitation to people in your contacts to use Bloom. In order to do that, we ask for your permission to access your contacts. Invitations are sent via text message, so you agree to any charges your carrier may charge you for sending those text messages.
If you allow access to push notifications, you can receive push notifications notifying you of things such as when someone sends you a message or follows you.
It is your responsibility to maintain safe and responsible practices to maintain the security of your account. This means creating a strong and unique password (preferably different from any other apps, websites or services you use). If your account has been hacked or you feel something suspicious is happening please contact us at support@bloomappone.com.
You understand that Bloom is a photo, video and location based app. In order to use the Services, Bloom requires access to your location data on your iOS or Android smartphone and to store some of that location data. You will have to give Bloom permission before it can access your location data. You can remove the location permission in the Settings of your iOS or Android smartphone.
You understand that under normal conditions, Services will work as expected but the accuracy of the location data can vary based on several factors such as your network coverage, wifi connection, your location in the world (or other planets), etc. This may affect how accurate your Services will be.
You understand that the location data of your smartphone is only used to (i) get your location when you upload a photo or video, (ii) get your location when querying for posts near you, and (iii) determine how far away a post is from your location.
Bloom does not use your location data to track you in real-time. Bloom does not store any real-time location data on you.
The maps we show in the app are native maps to iOS and Android respectively. Your location displayed on those maps comes from iOS and Android APIs respectively.
Our Services let you create, upload, post, send, receive and store different types of content. When you do that, you retain any ownership rights in that content you had to begin with. However, you grant us a license to use that content.
Posts or content you upload that is visible by everyone is “Public Content”. For all other content you submit to the Services other than Public Content, you grant Bloom and our affiliates a worldwide, solar system-wide, sublicensable, royalty-free, and transferable license to use, store, host, display, modify, adapt, reproduce, edit, distribute and publish that content. This license is for the limited purpose of developing, providing, operating, improving, promoting and improving the Services and for researching and developing new ones.
Because Public Content is inherently public and chronicles matters of public interest, the license you grant us for this content is much broader. For Public Content, you grant Bloom, our affiliates, and our business partners all of the same rights you grant for non-Public Content, as well as a perpetual license to create derivative works from, exhibit, promote, broadcast, syndicate, publicly display, publicly perform Public Content in any form, any way and in any and all media or distribution methods (either now known or later developed). To the extent it’s necessary, when you create, appear in, post, upload or send Public Content, you also grant Bloom, our affiliates, and our business partners the unrestricted, worldwide, solar system-wide, perpetual right and license to use your name, likeness and voice, including in connection with commercial or sponsored content. This means that (in addition to other things) that you will not be entitled to any compensation from Bloom, our affiliates, or our business partners if your name, likeness, or voice is conveyed through the Services, either on the Bloom app or on any of our business partner’s platforms.
We may also screen, review access,, and delete your content at any time and for any reason, including to provide and develop the Services or if we think your content violates these Terms in any way.. However, you alone remain responsible for the content you create, post, upload, send, save or store through the Service.
The Services may contain advertisements. In consideration for Bloom letting you access and use the Services, you agree that Bloom, our affiliates, and our third-party partners may place advertising on or throughout the Services. Due to the fact that the Services contain content that you and other people on the platform provide us, advertising may sometimes appear near your content or not.
Bloom grants you a personal, worldwide, interplanetary, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable licence to use and access the Services. This licence is for the sole purpose of letting you enjoy and use the Services’ benefits in a way that the Terms outlined here allow.
The app may be automatically downloaded and installed for upgrades, updates or new features. These are controlled by your operating system on your iOS or Android device. You understand it is your responsibility to manage these Settings of your smartphone device.
You may not modify, copy, distribute, sell, lease, or hack any part of our Services, nor may you reverse engineer or try to extract the source code of that software, unless laws prohibit these restrictions or you have our explicit, written permission to do so. Most of the content on our Services is created by users, other publishers or other third parties. Regardless of whether that content is posted or sent publicly or privately, the content is the sole responsibility of the person or organization that submitted it. While Bloom reserves the right to remove, review and delete all content that appears on the Services, we do not necessarily review it all. Therefore, we cannot and do not take responsibility for any content that others provide through the Services.
We outline in these Terms that we do not want our Services used for ill or bad uses. However, because we cannot possibly review all content, we cannot guarantee that the content on the Services or that the experience of a user’s use of our Services will always conform to our Terms.

We try hard to keep our Services useful and safe to all people. However, we cannot guarantee it. You must also step in and actively participate. This means you will take all precautions to remain safe while using the Services. For example, this means you will not use the services if you are distracted obeying traffic laws or other laws if you are driving. Also, you agree that by using these Services:
Services, features or functionality that is operated by a third party and made available through our Services (including Services we offer together with the third party), will be governed by each party’s terms. Those terms will be the party’s relationship with you. Bloom is not responsible or liable for a third party’s terms or any actions taken under the third party’s terms.
We are constantly growing and improving our Services. Bloom may add or remove features, products or functionality. We also might temporarily or indefinitely suspect or stop the Services altogether. We will attempt to notify you when this happens but that may not always be possible.
Bloom may terminate these Terms with you if you fail to comply with these Terms, the law or any other reason that may arise. We will attempt to give you advanced notice but that is not always possible. We reserve the right to stop providing you these Services or impose any limitations on you from using these Services. We may delete your account or suspect your account.
If you would like to terminate these Terms, you can do so at any time and for any reason by deleting your account. Please contact us at support@bloomappone.com to delete your account.
You agree, to the extent permitted by law, to defend, indemnify and hold harmless Bloom, Ready App One LLC, and our officers, affiliates, directors, stockholders, employees, licensors, agents, suppliers from any claims, charges, complaints, losses, damages, costs, liabilities and expenses (including attorneys’ fees) due to, arising out of, or relating in any way to: (a) your access to or use of the Services; (b) your content; and (c) your breach of these Terms.
We attempt to keep the Services up and running and free of issues but that is not always possible.
The Services are provided “as is” and “as available” and to the extent permitted by law without warranties of any kind, either express or implied, including, in particular implied warranties, conditions, or other terms relating to (i) fitness for a particular purpose,, satisfactory quality, merchantability, title, quiet enjoyment, non-infringement, or (ii) arising from a course of dealing. In addition, while Bloom attempts to provide a good user experience, we do not warrant or represent that: (a) the Services will always be secure, timely or error-free; (b) the Services will always function without disruption, delays, issues or imperfections; or (c) that any content or information you obtain through the Services will be accurate or timely.
IF THE LAW OF THE COUNTRY WHERE YOU LIVE DOES NOT ALLOW THE EXCLUSIONS OF LIABILITY PROVIDED FOR IN THIS CLAUSE, THOSE EXCLUSIONS SHALL NOT APPLY.
Bloom and their affiliates take no responsibility and assume no liability for any content that you, another person, or a third party creates, posts, uploads, sends, receives, caches or stores on or through our Services. You understand and agree that you may be exposed to content that might be illegal, offensive, misleading, false or otherwise inappropriate, none of which Bloom, nor their affiliates will be responsible for.
Nothing in these Terms will exclude or limit any responsibility we may have to remove content if so required by the law of the country where you live.
Bloom and our directors, affiliates, stockholders, officers, suppliers, licensors, employees, and agents will not be liable for any incidental, indirect, punitive, consequential, special, or multiple damages, or any loss of revenues or profits, whether incurred directly or indirectly, or any loss of use, data, goodwill or other intangible losses, resulting from: (a) your use of the Services or inability to use the Services; (b) your access to or inability to access the Services; (c) the conduct or content of other users of the Services or third parties on or through the Services; or (d) use or alteration of your content, unauthorised access. In absolutely no event will Bloom or their affiliates’ aggregate liability for all claims relating to the Services exceed the greater of $100 USD.
IF THE LAW OF THE COUNTRY WHERE YOU LIVE DOES NOT ALLOW ANY LIMITATION OF LIABILITY PROVIDED FOR IN THIS CLAUSE, THAT LIMITATION WILL NOT APPLY.

To the extent that these Terms allow you or Bloom to initiate litigation in a court, both you and Bloom agree that all claims and disputes (whether tort, contract, or otherwise), including disputes and statutory claims, arising out of or relating to the Terms or the use of the Services will be litigated exclusively in the United States and a state of Bloom’s choosing. You and Bloom consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable, then that provision will be severed from these Terms and will not affect the validity and enforceability of any other remaining provisions.
